We´re happy about your interest in our company. In accordance with the  requirements of Art. 13, 14 and 21 of the General Data Protection Regulation  (GDPR) we inform you hereby about the processing of personal data submitted by  you as a part of the application process and, if applicable, collected by us  and your rights in this regard. That we can be sure you´re fully informed about  your rights and the processing of your data in our application process, please  have a look to the following information. We ask you to take note of them.

3. Purpose and legal basis of  procession    

We process your personal data in harmony with the provisions of the DSGVO and the Bundesdatenschutzgesetz (BDSG), if it is necessary for a decision over a justification for a employment relationship with us. Legal Basis therefore is the Art. 88 DSGVO in connection with§ 26 BDSG and if necessary Art. 6  Abs 1 lit. b. DSGVO for the initation or execution of contractual  relationships. Furthermore we can process personal data of you, insofar as this  is necessary for the fulfillment of legal obligations (Art. 6 para. 1 lit. c  DSGVO) or for the defense of asserted legal claims against us. Legal basis in  this case is Art. 6 para. 1 lit. f DSGVO. A authorized interest is for example  a burden of proof in a procedure according to the General Equal Treatment Act  (AGG). If you give us a express consent for special purposes, the legitimacy of  this processions based on your consent according to Art. 6. Para. 1 lit. a  DSGVO is given. A Consent which is given can be revoked at any time by you,  with effect for the future (see section 9 of this data protection information).  If it comes to an employment relationship between you and us, we can –  according to Art. 88 DSGVO in conjunction with § 26 BDSG- reprocess your  personal data for the purpose of the employment relationship, if its necessary  for the ending or the procession. 

      

4. Categories of personal data    

We process only the kind of data, which relate to your application. This  could be general data to your person (name, Adress, contact Data, Birthdate),  Information to your professional qualification and your school education,  information about your professional, further educations and if necessary  further data, which were sent by you belonging to your application.    

    

5. Origin of the data
We process personal data, we received – cause of your contact to us - by your  Application via Post, Mail or our Applicant form.

     

6. Receiver of the data 

We send your application only to this persons and areas, who need them to fill their contractual and legal obligations or for an implementation of our legitimate interest require. This referes to authorized employee in our HR Team or in the hiring process involved persons. We can also send your personal data to companies which are connected to us, insofar as this is permissible within the framework of the purposes and legal bases set out in section 3 of this data protection declaration. The data of your application will be transmitted by a TLS- Encryption and also be saved in a database. This database is operated by Personio GmbH, which offers a Personnel administration and applicant management software. In this context, Personio is our processor according to Art. 28 DS-GVO. The base for this Processing is therefore a contract for a processor according between us as responsible site and personio.

Otherwise, your data will only be passed on to recipients outside the company if this is permitted or required by law, if the transfer is necessary to fulfill legal obligations or if we have your consent. Your data will not be transferred to a third country.


7. Duration of data storage

We save your personal data as so long as this is necessary for our decision about your application. Your personal data and your application will be saved until a maximum of 6 months after ending of the hiring process. After that they´ll be deleated unless longer storage is legally required or permitted. We store your personal data beyond this only insofar as this is required by law or in the specific case for the assertion, exercise or defense of legal claims for the duration of a legal dispute. In the case you´d agreed a longer duration of storage your data we´ll store them in accordance with your declaration of consent. If it comes within the hiring process to an employment relationship, a training relationship or a internship relationship we´ll save your data, if necessary and permissible, furthermore. The personal data will be transferred to your personnel file. If necessary you´ll get an invitation to transfer your personal data and your application in our talent pool after our hiring process. This allows us to contact you for further positions in our company. We´ll inform you in time about the planned inclusion in our talentpool and therefore we´ll obtain your consent for this. If you agree to save your data in our talent pool we´ll store your for the duration of 12 months in accordance with your consent.

  

8. Your rights 
Every affected person has the right of information after Art. 15 DSGVO, the right to authorization after para. 16 DSGVO, the right to deletion after para. 17 DSGVO, the right to resctriction of processiong after Art. 18 DSGVO, the right to communicate after para. 19 DSGVO and the right of data transimission after Art. 20 DSGVO.

In addition, there is a right of appeal to a data protection supervisory authority pursuant to Art. 77 DSGVO, if you are the opinion, that the procession of your personal data does not take place lawfully. The right of appeal is without prejudice to any other administrative or judicial remedy. If the processing of data is based on your consent, you are entitled to revoke your consent to the use of your personal data at any time in accordance with Art. 7 DSGVO.

Please note that the revocation is only effective for the future. Processing, which took place before the revocation is not affected. Please note furthermore, that that we may need to retain certain data for a certain period of time in order to comply with legal requirements (see section 7 of this privacy statement).

  

Right of objection

Insofar as the processing of your personal data is carried out in accordance with Art. 6 para. 1 lit. f DSGVO for the protection of legitimate interests, you have the right, in accordance with Art. 21 DSGVO, to object to the processing of this data at any time for reasons arising from your particular situation. In this case we process your personal data not anymore, unless we can demonstrate compelling legitimate grounds for the processing.  These must override your interests, rights and freedoms, or the processing must serve the assertion, exercise or defense of legal claims.


9. Necessity of the provision of personal data    

The provision of personal data in the context of application processes is neither legally nor contractually required. You are therefore not obliged to provide information about your personal data. Please note, however, that these are required for the decision on an application or the conclusion of a contract relating to an employment relationship with us. If you do not provide us with any personal data, we will not be able to make a decision regarding the establishment of an employment relationship. We recommend that you only provide personal data in your application that is required to complete the application.

    

10. Automated decision making 

Since the decision about your application is not based exclusively on automated processing, no automated decision in individual cases within the meaning of Art. 22 DSGVO takes place.

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Without this data, it would, in some cases, be technically impossible to deliver or display the contents of the software. In addition, processing this data is absolutely necessary under security aspects, in particular for access, input, transfer, and storage control. Furthermore, this anonymous information can be used for statistical purposes and for optimizing services and technology. In addition, the log files can be checked and analyzed retrospectively when unlawful use of the software is suspected. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. Generally, data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp of the access to the software is collected. The scope of this log process does not exceed the common log scope of any other site on the web. These access logs are stored for a period of up to 7 days. There is no right to object to this.

Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.

Use of cookies

So-called cookies are used on parts of this recruitment website. They are small text files which are stored on the device with which you access this recruitment website. As a general rule, cookies serve the purpose of ensuring secure access to a website (“absolutely necessary”), implementing certain functionalities such as standard-language settings (“functional”), improving the user experience or the performance of the website (“performance”), or placing targeted advertisements (“marketing”). On this recruitment website, we generally use only cookies that are absolutely necessary, functional or performance-related, in particular for implementing certain default settings such as language, for identifying the job advertising channel, or for analyzing the performance of a job advert via which a user accessed this recruitment website. Rights of data subjects

KG as the controller processes personal data, you as the data subject have certain rights under Chapter III of the EU General Data Protection Regulation (GDPR), depending on the legal basis and the purpose of the processing, in particular the right of access (article 15 of the GDPR) and the rights to rectification (article 16 of the GDPR), erasure (article 17 of the GDPR), restriction of processing (article 18 of the GDPR), and data portability (article 20 of the GDPR), as well as the right to object (article 21 of the GDPR). If the personal data is processed with your consent, you have the right to withdraw this consent under article 7 III of the GDPR. To assert your rights as a data subject in relation to the data processed for the purpose of operating this recruitment website, please refer to Personio SE & Co. Concluding provisions

Personio reserves the right to adjust this data privacy statement at any point in time to ensure that it is in line with the current legal requirements at all times, or in order to accommodate changes in the services offered, for example when new services are introduced. In this case, the new data privacy statement applies to any later visit of this recruitment website or any later job application.
